Official Terms of Service regarding the game Last Mortem BR(tm).

1. Intellectual property rights

This software program and the accompanying written materials are the copyrighted property of JurajHusek Game Studio(tm).


2. Use and Restrictions

This license allows you to use one copy of the software on a computer. You're not allowed to provide access to the software to multiple computers over any network at the same time.

You can make copies of the software in a machine-readable form for backup purposes; assuming that the backup copies contain all copyright or other proprietary notices.

Sharing or use of the software with other people at the same time is a violation of this license.

The software may not be used for commercial purposes, except if you have a written agreement with JurajHusek Game Studio(tm).

Cheating, cracking, hacking or another harmful activity is forbidden! We reserve the right to cancel the access to the game of any player who violates the Terms of Service.


3. Transfer

You may not rent, lease, loan, distribute or sublicense the software.

4. Microtransactions

We offer you the ability to collect virtual currency called Credits or buy virtual currency Credits for real-world money (this act is called Microtransaction). Using this virtual currency, players can buy virtual items. Players do not in fact own virtual in-game goods or items and virtual currency. Virtual items do not refer to any credit balance or real currency or its equivalent. Any virtual currency balance shown on account of a player does not constitute a real-world balance or reflect any stored value.

Virtual currency (called Credits in the game) can be purchased with real-world money using a third-party service. Please note that Juraj Husek Game Studio(tm) often does not handle any of the transactions of virtual currency. Your purchase of in-game virtual currency (Credits in in the game) is subject to the terms and conditions of the third-party services or parties handling the transactions. All of the Microtransactions are handled by PlayFab and PayPal.

In addition to any third-party obligations, the following shall apply. In no way can virtual currency or virtual items be redeemed for real-world money, goods, or other items. Transfers of virtual currency or virtual items outside of the game are strictly prohibited. 

You also agree that all sales of virtual currency are final. Neither third parties nor Juraj Husek Game Studio(tm) will give any refunds. In the event that your account is terminated or suspended for any reason, in Juraj Husek Game Studio(tm)'s sole and absolute discretion, or if Juraj Husek Game Studio(tm) discontinues the game service, you forfeit any and all virtual currency and items. Juraj Husek Game Studio(tm) has the absolute right to manage, regulate, control, modify, and eliminate virtual currency and virtual items as it sees fit in its sole discretion, and Juraj Husek Game Studio(tm) shall have no liability to you or anyone for the exercise of such rights.

5. Privacy Policy

To register an account in Last Mortem BR(tm) you have to agree to our Terms of Service, every time you play the game you automatically agree to our Terms of Service. By registering an account in Last Mortem BR(tm) you agree to collect personal information about yourself such as email address, location, and IP address. All of the information is safely stored in our PlayFab title (see more about PlayFab and its security here:https://playfab.com/). Your personal information may be then used byPlayFab as defined here: https://playfab.com/terms/. We never intentionally share your personal data with any other third-party company or individuals!

6. Termination

This license is effective until terminated. Your rights under this license shall expire automatically without notice from Juraj Husek Game Studio(tm) if you do not follow the terms of this license agreement. Upon the termination of this license, you destroy all copies of the software.

7. Disclaimer of warranties

YOU ACKNOWLEDGE AND EXPRESSLY AGREE THAT THE USE OF THE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. WITH THE EXCEPTION OF THE GUARANTEE ON MEDIA, "AS SEEN", THE SOFTWARE IS PROVIDED WITH ALL FAULTS AND WITHOUT WARRANTY.

ALSO, IT'S NOT POSSIBLE FOR JURAJHUSEK GAME STUDIO(tm) TO GUARANTEE ALWAYS THE ONLINE-FUNCTION (MULTIPLAYER), BECAUSE THE NETWORK-SOFTWARE IS BASED ON THIRD PARTY SOFTWARE AND SERVICES (PHOTON / https://www.photonengine.com/).

8. Limitation of liability

JURAJ HUSEK GAME STUDIO(tm) SHALL NOT BE LIABLE FOR PERSONAL INJURY OR INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, COMMERCIAL DAMAGES, OR LOSS, ARISING OUT OF OR IN CONNECTION WITH THE USE OR USE OF THE SOFTWARE.

9. Miscellaneous

(a) Last Mortem BR EULA is governed by the laws of the Slovak republic.

(b) the software may not be used for unlawful acts. If parts of this software are not allowed to use in your country, you should not install this software.

(c) if any provision of this agreement should be unlawful, void, or unenforceable for any reason, then that doesn't touch the validity or enforceability of the remaining provisions of this agreement.

Voce pode fazer cópias do software em um formato legível por máquina para fins de backup; assumindo que as cópias de backup contem todos os direitos autorais ou outros avisos de propriedade.
Compartilhar ou usar o software com outras pessoas ao mesmo tempo é uma violaçao desta licença.
O software nao pode ser usado para fins comerciais, exceto se voce tiver um contrato por escrito com o JurajHusek Game Studio(tm).
É proibido trapacear, crackear, hackear ou outra atividade prejudicial! Reservamo-nos o direito de cancelar o acesso ao jogo de qualquer jogador que viole os Termos de Serviço.

3. Transferencia
Voce nao pode alugar, arrendar, emprestar, distribuir ou sublicenciar o software.

4. Microtransaçoes
Oferecemos a voce a capacidade de coletar moeda virtual chamada Créditos ou comprar Créditos de moeda virtual por dinheiro do mundo real (este ato é chamado de Microtransaçao). Usando esta moeda virtual, os jogadores podem comprar itens virtuais. Na verdade, os jogadores nao possuem bens ou itens virtuais no jogo e moeda virtual. Os itens virtuais nao se referem a qualquer saldo de crédito ou moeda real ou seu equivalente. Qualquer saldo de moeda virtual mostrado na conta de um jogador nao constitui um saldo do mundo real ou reflete qualquer valor armazenado.
A moeda virtual (chamada de Créditos no jogo) pode ser comprada com dinheiro do mundo real usando um serviço de terceiros. Observe que o Juraj Husek Game Studio(tm) geralmente nao lida com nenhuma das transaçoes de moeda virtual. Sua compra de moeda virtual no jogo (créditos no jogo) está sujeita aos termos e condiçoes dos serviços de terceiros ou das partes que lidam com as transaçoes. Todas as microtransaçoes sao tratadas pelo PlayFab e pelo PayPal.

Além de quaisquer obrigaçoes de terceiros, aplica-se o seguinte. De forma alguma, a moeda virtual ou os itens virtuais podem ser trocados por dinheiro, bens ou outros itens do mundo real. Transferencias de moeda virtual ou itens virtuais fora do jogo sao estritamente proibidas.
Voce também concorda que todas as vendas de moeda virtual sao definitivas. Nem terceiros nem Juraj Husek Game Studio(tm) farao qualquer reembolso. No caso de sua conta ser encerrada ou suspensa por qualquer motivo, a critério exclusivo e absoluto do Juraj Husek Game Studio(tm), ou se o Juraj Husek Game Studio(tm) descontinuar o serviço de jogo, voce perderá toda e qualquer moeda virtual e itens. Juraj Husek Game Studio(tm) tem o direito absoluto de gerenciar, regular, controlar, modificar e eliminar moeda virtual e itens virtuais como achar melhor a seu exclusivo critério, e Juraj Husek Game Studio(tm) nao terá nenhuma responsabilidade perante voce ou qualquer pessoa pelo exercício de tais direitos.

5. Política de Privacidade
Para registrar uma conta no Last Mortem BR(tm) voce precisa concordar com nossos Termos de Serviço, toda vez que voce jogar o jogo voce concorda automaticamente com nossos Termos de Serviço. Ao registrar uma conta no Last Mortem BR(tm) voce concorda em coletar informaçoes pessoais sobre voce, como endereço de e-mail, localizaçao e endereço IP. Todas as informaçoes sao armazenadas com segurança em nosso título PlayFab (veja mais sobre PlayFab e sua segurança aqui: https://playfab.com/). Suas informaçoes pessoais podem ser usadas pela PlayFab conforme definido aqui: https://playfab.com/terms/. Nunca compartilhamos intencionalmente seus dados pessoais com qualquer outra empresa ou indivíduo de terceiros!


6. Rescisao
Esta licença é válida até ser rescindida. Seus direitos sob esta licença expirarao automaticamente sem aviso do Juraj Husek Game Studio(tm) se voce nao seguir os termos deste contrato de licença. Após o término desta licença, voce destrói todas as cópias do software.


7. Renúncia de garantias
VOCE RECONHECE E CONCORDA EXPRESSAMENTE QUE O USO DO SOFTWARE É POR SUA CONTA E RISCO E QUE TODO O RISCO QUANTO A QUALIDADE SATISFATÓRIA, DESEMPENHO, PRECISAO E ESFORÇO É COM VOCE. COM EXCEÇAO DA GARANTIA NA MÍDIA, "COMO VISTO", O SOFTWARE É FORNECIDO COM TODAS AS FALHAS E SEM GARANTIA.
TAMBÉM, NAO É POSSÍVEL A JURAJHUSEK GAME STUDIO(tm) GARANTIR SEMPRE A FUNÇAO ONLINE (MULTIPLAYER), PORQUE O SOFTWARE DE REDE É BASEADO EM SOFTWARE E SERVIÇOS DE TERCEIROS (PHOTON / https://www.photonengine.com/).

8. Limitaçao de responsabilidade
O JURAJ HUSEK GAME STUDIO(tm) NAO SERÁ RESPONSÁVEL POR DANOS PESSOAIS OU DANOS INCIDENTAIS, ESPECIAIS, INDIRETOS OU CONSEQUENTES DE QUALQUER TIPO.
ISTO INCLUI DANOS POR PERDA DE LUCROS, PERDA DE DADOS, INTERRUPÇAO DE NEGÓCIOS, DANOS COMERCIAIS OU PERDAS, DECORRENTES DE OU EM CONEXAO COM O USO OU USO DO SOFTWARE.

9. Diversos
(a) Last Mortem BR EULA é regido pelas leis da República Eslovaca.
(b) o software nao pode ser usado para atos ilícitos. Se partes deste software nao puderem ser usadas em seu país, voce nao deve instalar este software.
(c) se qualquer disposiçao deste contrato for ilegal, nula ou inexequível por qualquer motivo, isso nao afeta a validade ou exequibilidade das demais disposiçoes deste contrato.
